Code Enforcement & Zoning Administration
The Town’s Code Enforcement Officer helps to ensure compliance with the Town’s ordinances. Minimum standards apply to things such as housing, overgrowth of vegetation, outdoor storage, abandoned/inoperable vehicles and overall maintenance of property. Meeting these minimum requirements helps to ensure a quality of life for Mooresville’s residents and visitors.

When we receive a complaint, our Code Enforcement Officer investigates to verify there is in fact a violation of the ordinance. If there is, a Notice of Violation is sent to the property owner. In most cases, the property owner has 15 calendar days to correct the violation. If it is not corrected, we then begin imposing fines of $100/day until correction. Eventually, depending on the type and severity of the violation, the Town may bring legal action upon the property owner to collect the civil penalties and obtain compliance with the ordinance.

Mooresville’s Top Ten List – Code Enforcement Violations
#1 - Junk, Trash and Debris|
Otherwise known as: Garbage day is just too far away
It is a public nuisance to have a concentration of rubbish, trash, discarded appliances or furniture or any other manner of discarded property as these threaten the economic values of the neighborhood and are prejudicial to the public health. (Section 14-90 (2) of the General Code)
#2 – Inoperable Vehicles|
Otherwise known as: Uncle Milton’s “classic” car that just might run …. someday.
The Town’s Code Enforcement Officer to declare any abandoned, junked or nuisance motor vehicle remaining on private property in excess of thirty days a health or safety hazard. (Section 14-28 of the General Code)
#3 – Overgrown Conditions|
Otherwise known as: Uncle Milton can’t find his car in all that grass.
Grass and weeds higher than 12 inches (on most lots) is considered a public nuisance, and a health hazard. (Section 14-90 (1) of the General Code)
#4 – Fence Violations|
Otherwise known as: Uncle Milton wants everyone to see that car … and the grass.
All fences and walls shall be maintained in good repair and in a safe and attractive condition. Anything that is deteriorated, damaged or decayed shall be promptly repaired or replaced. This includes both structural and decorative elements of the fence or wall. (Section 9.3.7(6) of the Code of Ordinances)
#5 – Improper outside/open storage|
Otherwise known as: Time for Uncle Milton to build a shed *
Depending on the zoning designation, outdoor storage may not be allowed, or may be allowed only with adequate screening from neighboring properties. Unenclosed porches facing a public right-of-way may not be used for storage of anything at any time. (Sections 14-96 and Section 14-97 of the General Code) * Some restrictions may apply
#6 – Work without a permit|
Otherwise known as: The new shed was built to Uncle Milton’s specifications (bad idea)
Construction or alteration of a building or addition of any outside structures must obtain a zoning permit from the Town prior to a building permit from Iredell County to ensure compliance with Town zoning regulations. (Chapter 2.3.11 of the Zoning Ordinance)
#7 – Sign Violations|
Otherwise known as: Uncle Milton’s advertising agency
Temporary signs may not be installed without a sign permit issued by the Town, and under no circumstances shall any temporary signs advertising a business be installed within the right-of-way. (Chapter 8 of the Zoning Ordinance)
#8 – Unsafe Structures|
Otherwise known as: A hole in the roof does not count as a skylight
The Town has minimum housing and commercial codes that speak to the general safety and livability of residences and businesses. Properties must be secured, structurally sound, with adequate utilities available. (Section 5-26 of the General Code, and the Minimum Housing Code Ordinance)
#9 – Unpermitted Home Occupation|
Otherwise known as: Home Sweet …… Business?
Zoning regulations define the type and location of businesses and housing throughout the Town. Some types of home occupations are allowed within residential districts. They must receive a use permit from the Town. Outdoor signage or alterations to the house to indicate the nature of the building is not allowed. (Chapter 5.4.3 (7) of the Zoning Ordinance)
#10 – Improper Tree Removal (Commercial property only)|
Otherwise known as: Just take a little off the top
Landscaping, including canopy and understory trees, is required for all commercial or retail sites. Standard maintenance of trees such as regular pruning is encouraged; however trees cannot be trimmed of more than 25% of the canopy. If vegetation must be removed due to age or disease, it must be replaced with a comparable planting. (Chapter 7 of the Zoning Ordinance)
